Aerial Pro Imaging Terms of Use & Service Agreement

Welcome to Aerial Pro Imaging . By scheduling, booking, purchasing, or using our services, you agree to the following Terms of Use and Service Agreement.
1. Services
Aerial Pro Imaging provides professional real estate media services, including but not limited to:
* Real estate photography
* Aerial/drone photography
* Videography
* Social media content
* Virtual tours
* Floor plans
* Virtual twilight renderings
* Virtual staging
* Image enhancement and editing
* Commercial real estate media
* Construction progress documentation
All services are subject to availability, weather conditions, FAA regulations, and site accessibility.
2. Payment Terms
Payment Due at Booking
Full payment is due at the time of booking unless otherwise agreed to in writing by Aerial Pro Imaging.
A scheduled appointment is not considered confirmed until payment has been received.
Accepted payment methods may include online payment, credit card, ACH, invoice payment, or other approved methods.
Aerial Pro Imaging reserves the right to withhold delivery of any media until all outstanding balances have been paid in full.
3. Cancellation & Refund Policy
Client Cancellation
If a client cancels an appointment after payment has been made, no monetary refund will be issued.
Instead, the amount paid will be converted into a service credit equal to the value of the original payment.
Credits may be applied toward future services provided by Aerial Pro Imaging.
Credits are non-transferable unless approved in writing by Aerial Pro Imaging.
Rescheduling
Clients may reschedule appointments subject to availability.
Appointments rescheduled with less than 24 hours notice may be subject to a rescheduling fee of $35.
Weather Delays
Drone operations and certain photography services may be delayed due to weather, lighting conditions, FAA restrictions, or safety concerns.
Weather-related postponements initiated by Aerial Pro Imaging will not incur any fees and will be rescheduled at the earliest mutually available time.
4. Property Access
The client is responsible for ensuring:
* Property access is available at the scheduled appointment time.
* Utilities are active if interior photography is requested.
* The property is photo-ready before arrival.
* Pets are secured.
* Occupants are informed of the appointment.
If access is denied or the property is not ready upon arrival, additional fees may apply.
5. Media Delivery
Typical delivery timelines:
* Photography: Within 24 hours
* Video projects: Typically 48-72 hours
* Specialized editing services: Varies by project
Delivery times are estimates and may vary based on workload, weather, technical issues, or project complexity.
6. Copyright & Licensing
All photographs, videos, drone imagery, floor plans, virtual staging, virtual twilight images, and other media created by Aerial Pro Imaging remain the exclusive intellectual property of Aerial Pro Imaging and are protected under United States Copyright Law.
Purchase of services grants the client a limited, non-exclusive, non-transferable license to use the delivered media solely for marketing and promotion of the specific property for which the media was created.
Clients may not:
* Sell the media
* Transfer the media to another agent, broker, builder, photographer, or third party
* Alter, edit, manipulate, filter, or modify the media without written permission
* Use the media for AI training, machine learning, image generation, or derivative works
* Reuse the media for future listings after expiration of the original listing agreement
Additional licensing may be available upon request.
7. Virtual Staging & Rendered Images
Virtual staging, virtual twilight, virtual renovations, and other digitally enhanced images are artistic renderings intended for marketing purposes.
Clients are responsible for complying with all MLS, broker, and advertising disclosure requirements regarding digitally altered images.
8. Drone Operations
All drone services are conducted in compliance with:
* FAA Part 107 regulations
* Airspace restrictions
* Temporary Flight Restrictions (TFRs)
* Local laws and ordinances
Aerial Pro Imaging reserves the right to modify or cancel drone operations when safety, legality, or weather conditions require it.
No refund will be issued for portions of a service that cannot legally or safely be completed; however, an appropriate service credit may be issued at Aerial Pro Imaging's discretion.
9. Limitation of Liability
Aerial Pro Imaging's liability for any claim arising from services provided shall be limited to the amount paid for the specific service giving rise to the claim.
Under no circumstances shall Aerial Pro Imaging be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages.
10. Force Majeure
Aerial Pro Imaging shall not be liable for delays or inability to perform services due to circumstances beyond its reasonable control, including but not limited to:
* Weather conditions
* Natural disasters
* Government restrictions
* FAA restrictions
* Equipment failure
* Internet outages
* Illness or emergencies
11. Acceptance of Terms
By scheduling, purchasing, paying for, or receiving services from Aerial Pro Imaging, the client acknowledges that they have read, understood, and agree to these Terms of Use and Service Agreement.
